North Carolina’s Sexual Exploitation of a Minor Statutes

North Carolina statutes don’t use the phrase “child pornography.” The conduct is prosecuted under three degrees of sexual exploitation of a minor, found in Article 26 of Chapter 14 of the North Carolina General Statutes. Which degree applies to your situation determines the charge class and the sentencing range you face.

  • First-degree sexual exploitation of a minor (N.C.G.S. § 14-190.16): Covers producing or facilitating material depicting a minor in sexual activity. This is a Class C felony.
  • Second-degree sexual exploitation of a minor (N.C.G.S. § 14-190.17): Covers recording, distributing, or receiving such material. This is a Class E felony.
  • Third-degree sexual exploitation of a minor (N.C.G.S. § 14-190.17A): Covers knowing possession of such material. This is a Class H felony.

All three degrees require mandatory sex offender registration upon conviction. One critical point: mistake of age is not a defense under any of these statutes. A jury may infer that a person depicted is a minor based on how the material represents them, regardless of what the accused claims to have believed.

When a Case Moves Into Federal Court

Federal law governing child sexual abuse material is codified at 18 U.S.C. §§ 2251 through 2256. Because most material is obtained or transmitted over the internet, federal prosecutors frequently take jurisdiction rather than leaving the case at the state level.

The sentencing exposure in federal court is substantially higher. Receiving, distributing, or possessing with intent to distribute carries a statutory mandatory minimum of five years; production charges carry a mandatory minimum in the range of fifteen years. By contrast, a Class H felony possession charge under North Carolina law may allow for probation, depending on the defendant’s record and the circumstances. That gap between state and federal exposure is one reason early legal involvement is so important.
