Beechler Tomberlin, PLLC Secures $512,500 Jury Award in Contract Dispute

|

Beechler Tomberlin, PLLC is proud to announce a recent trial victory led by attorney Allison C. Tomberlin in Wilkes Superior Court. On September 15, 2025, a jury awarded our client, Stroud-Miller Insurance Service Inc., $512,500 in compensatory and liquidated damages after finding that a former employee violated the terms of her agency-producer agreement.

The case centered on claims that the employee, while still under contract, formed a competing insurance agency and diverted accounts away from Stroud-Miller in violation of her non-compete and confidentiality obligations. After hearing a week of testimony, the jury deliberated for less than three hours before reaching its verdict.

In addition to awarding damages to Stroud-Miller, the jury also found that the former employee was owed limited unpaid commissions totaling $17,624. The jury rejected her claim for additional vested commissions under the Wage and Hour Act.

This result underscores the importance of protecting business interests through well-drafted agreements and pursuing enforcement when those agreements are breached. Beechler Tomberlin, PLLC remains committed to advocating vigorously for our clients in complex business and employment disputes.
